In short

Rule 1 gives the Rules their name and sets three commencement groups, each expressed as a period running from the date of publication of the notification in the Official Gazette.

  • Rules 1, 2 and 17 to 21 come into force on the date of publication.
  • Rule 4 comes into force one year after the date of publication.

02Reading the commencement correctly

The Rules do not state calendar dates. They state periods from publication. Deriving a date is straightforward arithmetic, and the date is a property of the notification rather than of the rule text. Documents that assert a bare calendar date without attributing it invite a challenge that has nothing to do with the obligation being described.

Note also what Rule 1 does not do. It does not create a grace period, a transitional saving or a phased application within any single rule. A rule in the eighteen month group applies in full from the day it commences.
